1. General Terms
1.1. In accordance with the UK legislation,
an offer containing all the essential terms of the contract, from which the
will of the person making the offer is seen to conclude an agreement on the
conditions specified in the offer with anyone who responds, is recognized as an
offer (public offer), and the execution by the person who received an offer,
actions to fulfill the terms of the contract specified in it is considered the
conclusion of an agreement by the person who performed the specified action
with the person who made the corresponding offer.
1.2. This document is a public offer, i.e.
the Seller's proposal to conclude a retail sale and purchase agreement with any
individual on the basis of familiarization with the description of the goods
presented on the Site or in the Appendix.
1.3. The seller's obligations to transfer
the goods and other obligations related to the transfer of goods arise from the
moment the seller receives the corresponding message from the buyer about his
intention to conclude an agreement.
1.4. A person who agrees with the terms of
this Offer and all its annexes set out below has the opportunity to conclude a
retail sale and purchase agreement with the Seller, while in accordance with
the UK legislation, the moment the said person concludes the agreement purchase
and sale with the Seller on the terms set forth in this Offer will be the
moment the Seller receives a message about the buyer's intention to purchase
the goods. Given the importance of the above, a person interested in purchasing
goods on the terms set forth in this Offer is strongly advised to carefully
read its text, and in case of disagreement with any of its paragraphs, it is
proposed to refuse to purchase goods or use the services provided by the
Seller.
1.5. In this offer, unless the context
requires otherwise, the terms below have the following meanings:
"Seller", which operates under
the trademark "Just Katie" and sells the goods, the description of
which is presented on the Site / in the Appendix.
"Offer" - this document, which is
a public offer of the Seller, addressed to any individual, to conclude a retail
sale and purchase agreement for goods (hereinafter referred to as the
"Agreement") on the terms contained in the Offer, including all its
annexes.
"Buyer" - an individual who has
entered into an Agreement with the Seller on the terms contained in the Offer.
"Consumer" - a capable natural
person to whom this Offer is addressed.
"Product" - any product under the
brand name "Just Katie", the assortment list of which is presented on
the Site / in the Appendix.
"Acceptance" - full and
unconditional acceptance by the Buyer of the terms of the Offer, which is
confirmed by the transfer by the Buyer to the Seller of a message of his
intention to purchase the Goods and confirmation by the Seller of the fact of
receiving the Buyer's message in the manner specified in the Offer.
"Order" - the actions of the
Buyer, performed by him in the manner provided for in this Offer, with the aim
of acquiring individual items of the Goods, consisting in transmitting to the
Seller a message of intention to purchase the Goods.
"Delivery" - a service for the
delivery of the Order to the Buyer by the Seller or the Courier Service.
"Courier Service" - a third party
determined by the Seller and providing the Buyer with services for the delivery
of the Goods.
"Card" - a bank card issued by a
credit institution that allows the Buyer to use it to perform transactions with
funds held by the credit institution that issued the Card, in accordance with
the legislation of the UK and an agreement with a credit institution, including
transactions for payment for the Goods purchased from the Seller on the basis
of the Agreement.
"Support Center" is a support
center through which the Seller provides round-the-clock information and
reference services to Consumers / Buyers.
1.6. The term of the Offer in relation to
specific, individual items of the Goods from the assortment list of the Goods
presented on the Website or in the Appendix may be limited by the period of
availability of the corresponding items in the Seller's warehouse or by the
terms of this Offer.
2. Agreement subject
2.1. The Seller undertakes to sell, and the
Buyer undertakes to accept and pay for the Goods at the prices indicated in the
description of the Goods on the appropriate page of the Site / in the
Application on the terms of this Offer, the current version of which is posted
on the website
www.just-katie.co.uk is operated by LUV International with the registered address 129 Station RdHendon, London NW4 4NJ, under the laws of the UK, registration Number is 12845755 and its registered address is at 129 Station RdHendon, London NW4 4NJ.
3. Making an order
3.1. The ordering of the Goods is carried
out by the Buyer in the following ways:
3.1.1. using the website;
3.2. When placing an Order, the Buyer
undertakes to indicate the following data:
3.2.1. First Name Last Name;
3.2.2. contact phone number and email
address;
3.2.3. delivery method of the Order;
3.2.4. delivery address of the Order (if
the delivery of the Order is made by a courier);
3.2.5. method of payment for the Order.
3.3. The Order placed by the Buyer is a
message to the Buyer about the intention to purchase the Goods. The fact that
the Buyer has completed the Order and transmitted to the Seller a message of
intention to purchase the Goods is confirmed in one of the following ways:
3.3.1. sending an email by the Seller
through the Support Center by the contact email address specified when placing
the Order, and subsequent confirmation by the Buyer of the information provided
by the Buyer when placing the Order (clause 3.2. of this offer), as well as
clarifying the terms of Delivery.
3.2. The Buyer is solely responsible for
the content and accuracy of the data provided when placing the Order.
3.3. All information materials presented on
the Seller's Website are for reference only and cannot fully convey reliable
information about certain properties and characteristics of the Goods, such as:
color, shape, size and packaging. If the Buyer has any questions regarding the
properties and characteristics of the Goods, before placing the Order, the
Buyer must seek advice via the email address of the Support Center.
3.4. The Buyer agrees for the Seller to
process the Buyer's personal data in accordance with the UK legislation on
Personal Data Usage. Consent is given by the Buyer performing implicit actions
at the moment the Buyer presses the "I have read and agree with the terms
of the Offer for the purchase of goods button" when placing an Order on the
Website in order to fulfill the Agreement concluded with the Buyer by the
Seller. This condition applies to the information transmitted to the Seller by
the Buyer when placing the Order (clause 3.2 of the Offer), as well as bank
details when paying for the Order on the Site (hereinafter - "Personal
data").
3.5. Consent is provided for the Seller to
carry out, for the purposes provided for in this Offer, actions in relation to
the Buyer's Personal Data, including: collection, systematization, accumulation,
storage, clarification (update, change), use, distribution (including
transfer), depersonalization, blocking, destruction Personal data, as well as
for the Seller to make contacts with the Buyer, including for the purpose of
promoting goods, works, services on the market (using, including but not
limited to: ztz services, e-mail, postal and telephone communications), taking
into account the requirements of the current legislation of the UK.
3.6. The consent provided by the Buyer to
the processing of personal data is valid:
before the date of execution by the Seller
of the Agreement (delivery of the Goods to the Buyer);
before the date of execution by the Seller
of the Agreement (delivery of the Goods to the Buyer).
3.7. The Seller undertakes to stop processing
the Buyer's personal data and to destroy the Personal data within a period not
exceeding 30 (thirty) days from the date:
execution by the Seller of the Agreement
(delivery of the Goods to the Buyer);
obtaining a withdrawal of consent from the
Buyer.
4. Payment
4.1. The Buyer is obliged to pay for the
Goods included in the Order is possible in the following ways
4.1.1. By transferring funds in accordance
with the requirements of the current legislation of the UK based on the details
provided by the Seller to the Buyer by e-mail or on the Seller's website.
4.2. The price for each unit of the Goods /
the cost of delivery is indicated by the Seller when placing the Order and
additionally communicated to the Buyer in one of the ways specified in clause
3.3. of this Offer.
4.3. The Seller has the right to change the
price of the Goods indicated on the Website at any time without notifying the
Buyer, while the amount of money payable to the Seller for the Goods included
in the Order is determined based on the price of the Goods indicated on the
Website at the time conclusion of a retail sale and purchase agreement (clause
1.3. of this Offer).
4.4. The Seller's obligation to transfer
the Goods included in the Order to the Buyer arises only after the conclusion between
the Buyer and the Seller of a contract for the sale of Goods, the moment of
conclusion of which is determined in accordance with clause 1.3 of this Offer.
5. Delivery of goods to the buyer. Return or refusal from the order (delivered)
5.1. The conditions for the delivery of the
Goods, namely the delivery time and its cost, are established by the Seller and
communicated to the Buyer in one of the ways specified in clause 3
5.2. If the Buyer refuses the Goods on the
grounds provided for by the current legislation of the UK, in connection with
the identification of defects in the Goods, the Seller refunds to the Buyer the
cost of the returned Goods (taking into account all discounts provided, and the
Buyer is obliged to return the Goods to the Seller in respect of which the
refusal is declared in accordance with If the Seller has doubts about the
reason for the occurrence of the defects of the Goods declared by the Buyer,
the Seller has the right to request from the Buyer the Goods in respect of which
the refusal is declared, and to conduct an examination of such Goods with the
involvement of a specialized organization. If the Buyer refuses to provide the
Seller with the Goods for examination, The Seller has the right not to satisfy
the requirements of the Buyer if there are doubts about the reasons for the
defects. If the results of the examination confirm the absence of the Seller's
fault in the occurrence of the declared defects, the Seller is entitled to the
following:
refuse the Buyer to satisfy the declared
refusal of the Goods and return the money paid, as well as demand compensation
for the cost of the examination; or
Satisfy the Buyer's requirements regarding
the return of funds. If, according to the results of the examination, the
Seller's guilt in the occurrence of the declared defects is confirmed, the
Seller is obliged to satisfy the Buyer's declared requirements for the return
of the cost of the defective Goods.
5.3. When refunding the prepayment paid by
the Buyer by bank transfer, the bank commissions paid by the Buyer in this
regard are not compensated by the Seller.
6. Copyright
6.1. All visual and textual information and
graphics posted on the Seller's Website are the property of the Seller and / or
its suppliers and manufacturers of the Goods.
7. Seller's Responsibility
7.1. The Seller is not responsible for the
Buyer's improper use of the goods purchased under the contract, as well as for
individual intolerance to one or another component in the composition of the
Goods and / or allergic reactions as a result of using the Goods.
7.2. The Seller has the right to transfer
his rights and obligations to fulfill the Buyer's Order to third parties,
remaining responsible to the Buyer for providing the Goods ordered by the
Buyer.
7.3. The Seller has the right to record
telephone conversations with the Buyer. In accordance with the UK legislation,
the Seller undertakes to prevent attempts of unauthorized access to information
about the Buyer and / or transfer it to persons not directly related to the
execution of Orders, as well as in a timely manner detect and stop such
attempts.
7.4. The ownership of the Product specified
in the Order, as well as the risk of its accidental loss or damage, passes to
the Buyer from the moment the Buyer signs the acceptance certificate / invoice
for the transfer of the Product specified in the Order.
7.5. The Seller is released from liability for violation of the terms of Delivery in the event that the Buyer informs him about himself when placing the Order (clause 3.2. Of this Offer).
